Web Hosting Terms and Conditions
1. Agreement
By subscribing to the web hosting services of Smarter Tourism Technology Pty Ltd (hereinafter referred to as “the Company”), the client (hereinafter referred to as “the Client”) agrees to be bound by the following terms and conditions.
2. Service Provision
The Company agrees to provide web hosting services to the Client, which may include, but are not limited to, website hosting, email hosting, domain registration, and security services, as per the plan selected by the Client.
3. Service Use
The Client agrees to use the services provided in a manner consistent with all applicable local, state, and federal laws and regulations.
4. Payment Terms
Fees for the web hosting services are due in advance of the billing cycle selected by the Client. Late payments may result in the suspension or termination of services.
5. Cancellation and Refunds
The Client may cancel the web hosting services at any time. A prorated refund will be issued based on the remaining period of service, provided the Client has not violated these Terms and Conditions.
6. Service Level Agreement (SLA)
The Company guarantees a certain level of service availability and performance, as detailed in the Service Level Agreement (SLA), which is incorporated herein by reference.
7. Client Content
The Client is solely responsible for the content stored on and served by their hosting services. The Company is not responsible for any data loss, corruption, or backup of data unless specifically included in the Client’s service plan.
8. Prohibited Use
The Client shall not use the services to host content that is illegal, infringes on intellectual property rights, or is otherwise harmful (e.g., malware, spam, etc.).
9. Intellectual Property
All services provided by the Company, including related software and technology, remain the property of the Company and are protected by copyright, intellectual property laws, and international treaty provisions.
10. Privacy
The Company agrees to take reasonable steps to protect the personal information of the Client and to comply with all applicable data protection laws.
11. Indemnification
The Client agrees to indemnify, defend, and hold harmless the Company and its affiliates, officers, agents, and employees from any claims resulting from the Client’s use of the services which damages the Client or another party.
12. Limitation of Liability
The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use any of the services or for the cost of procurement of substitute services.
13. Modification of Terms
The Company reserves the right to modify these terms and conditions at any time, with notice provided to the Client.
14. Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Western Australia, without regard to its conflict of law provisions.
15. Severability
If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions of this Agreement will remain in effect.
16. Entire Agreement
These terms and conditions constitute the entire agreement between the Company and the Client with respect to the subject matter hereof and supersedes all prior agreements, whether written or oral.
